Probate Notices

From 1 March 2022 all notices of intention to apply for a grant of probate, letters of administration (with will), letters of administration (no will) and reseal of a foreign grant must be published on the ACT Supreme Court website. This replaces the previous requirement that probate notices be published in a daily newspaper generally circulating in the ACT. An online form is available to facilitate publication of probate notices on the ACT Supreme Court website.

New Probate Notices

To publish a new notice of intention to apply for a grant of probate, letters of administration (with will), letters of administration (no will) or reseal of a foreign grant, please:

The fee for publishing a probate notice is set out in the Schedule of Fees, and a credit card payment is required.

The notice must be published not less than 14 days, and not more than 3 months, before the day the application is filed in Court. Once a form is submitted, it will publish on the Search Probate Notices page. Note: there may be a delay of between 30 minutes to 1 hour before a notice is published.

For the purpose of any application made to the court, a copy of the notice can be downloaded as a PDF from the Search Probate Notices page.

Amend an existing Probate Notice

To amend an existing probate notice published on the ACT Supreme Court website, you must complete the online form and enter the reference code from the original published notice in the relevant field.  The reference code is 8 letter and number characters and can be found in the receipt from the original notice.

Amendments will be applied between 24-48 hours after the amendments are submitted.

You will need to note the date the amendments are applied, as the 14 day minimum notice requirement will restart from that time.
